SERVICE
Estos Términos del Servicio ("Términos") regulan el uso de la plataforma de detección de vulnerabilidades operada bajo el nombre comercial "Musha Security" ("Musha", "nosotros"), conforme a la legislación de la República de Colombia, disponible en mushasec.com y app.mushasec.com (el "Servicio"). Cuando creas una cuenta o usas el Servicio, aceptas estos Términos en su totalidad. Si no estás de acuerdo con ellos, te pedimos que no uses el Servicio. These Terms of Service ("Terms") govern the use of the vulnerability detection platform operated under the commercial name "Musha Security" ("Musha", "we"), under the laws of the Republic of Colombia, available at mushasec.com and app.mushasec.com (the "Service"). When you create an account or use the Service, you accept these Terms in full. If you don't agree with them, please don't use the Service.
01 DefinicionesDefinitions
- Cliente: la organización (empresa, entidad legal) que contrata el ServicioCustomer: the organization (company, legal entity) contracting the Service
- Usuario: persona natural autorizada por el Cliente para acceder al ServicioUser: natural person authorized by the Customer to access the Service
- Suscripción: el plan contratado (Starter, Team, Business, Enterprise) con su tier asociadoSubscription: the contracted plan (Starter, Team, Business, Enterprise) with its associated tier
- Período de Trial: 14 días de prueba inicial con tarjeta requeridaTrial Period: 14-day initial trial with required card
- Findings: vulnerabilidades, misconfigurations o secretos detectados por el ServicioFindings: vulnerabilities, misconfigurations, or secrets detected by the Service
- Datos del Cliente: toda la información que el Cliente carga, conecta o procesa a través del Servicio (incluyendo URLs de repos, branches, findings, audit logs)Customer Data: all information the Customer uploads, connects, or processes through the Service (including repo URLs, branches, findings, audit logs)
- Información Confidencial: toda información no pública intercambiada entre las partes en el contexto del Servicio, marcada o razonablemente entendida como confidencialConfidential Information: all non-public information exchanged between the parties in the context of the Service, marked or reasonably understood as confidential
- Día Hábil: lunes a viernes, excluyendo festivos oficiales colombianos, en horario UTC-5Business Day: Monday through Friday, excluding Colombian official holidays, in UTC-5 hours
02 El ServicioThe Service
Musha es una plataforma SaaS de detección automática de vulnerabilidades que cubre Software Composition Analysis (SCA), Infrastructure-as-Code (IaC) static analysis y Secrets detection. El Servicio se integra con tu Git provider via webhook, clona tu repositorio en un entorno efímero, ejecuta los scans y reporta findings via PR comment automático y dashboard.Musha is a SaaS platform for automatic vulnerability detection covering Software Composition Analysis (SCA), Infrastructure-as-Code (IaC) static analysis, and Secrets detection. The Service integrates with your Git provider via webhook, clones your repository in an ephemeral environment, runs scans, and reports findings via automated PR comment and dashboard.
El Servicio es una herramienta automatizada. No reemplaza un pentest manual con humanos, ni una auditoría formal de seguridad, ni la asesoría de un CISO. Hacemos nuestro mejor esfuerzo para detectar vulnerabilidades conocidas, pero no podemos garantizar que las atrapemos todas.The Service is an automated tool. It doesn't replace a manual human-driven pentest, a formal security audit, or CISO advisory. We do our best to detect known vulnerabilities, but we can't promise we'll catch every single one.
03 Suscripción y TiersSubscription and Tiers
El Servicio se ofrece en cuatro tiers (Starter, Team, Business, Enterprise) con límites de devs activos y scans/mes documentados en /pricing.html. El Cliente puede elegir facturación mensual (sin compromiso, cancelable en cualquier momento) o anual con descuento del 20% (pago upfront por 12 meses).The Service is offered in four tiers (Starter, Team, Business, Enterprise) with active dev and monthly scan limits documented at /pricing.html. The Customer may choose monthly billing (no commitment, cancellable anytime) or annual with 20% discount (upfront payment for 12 months).
Renovación automática: las suscripciones se renuevan automáticamente al final del período facturado a menos que el Cliente cancele antes. Notificamos por email 7 días antes de cada renovación.Auto-renewal: subscriptions auto-renew at the end of the billed period unless the Customer cancels before. We notify by email 7 days before each renewal.
Upgrade: permitido en cualquier momento. La proración se aplica automáticamente. Downgrade: se aplica al inicio del siguiente ciclo facturado.Upgrade: allowed anytime. Prorating is applied automatically. Downgrade: applies at the start of the next billed cycle.
04 PagosPayments
Los pagos de Starter, Team y Business se procesan a través de un tercero autorizado que emite las facturas, recauda los impuestos aplicables (IVA, VAT, sales tax) y actúa como vendedor frente al Cliente según la jurisdicción de éste.Payments for Starter, Team, and Business are processed through an authorized third party that issues invoices, collects applicable taxes (IVA, VAT, sales tax), and acts as seller to the Customer according to the Customer's jurisdiction.
Toda la moneda es USD (dólares estadounidenses). Métodos de pago aceptados: tarjetas Visa, Mastercard, American Express y métodos locales soportados por el tercero autorizado.All currency is USD (US dollars). Accepted payment methods: Visa, Mastercard, American Express cards, and local methods supported by the authorized third party.
El tier Enterprise se factura via invoice billing con términos Net 30 o Net 60 según contrato individual.Enterprise tier is billed via invoice billing with Net 30 or Net 60 terms per individual contract.
05 Cancelación y RefundsCancellation and Refunds
Plan Mensual: cancelable en cualquier momento. El plan sigue activo hasta el final del mes pagado. Sin refund del mes actual.Monthly Plan: cancellable anytime. Plan remains active until the end of the paid month. No refund of the current month.
Plan Anual: cancelable en cualquier momento. El plan sigue activo hasta el final del año pagado. 30-day money-back guarantee desde la fecha de cobro inicial — si cancelas dentro de esos 30 días, te reembolsamos el pago completo (sujeto a fair use policy).Annual Plan: cancellable anytime. Plan remains active until the end of the paid year. 30-day money-back guarantee from the initial charge date — if you cancel within those 30 days, we refund the full payment (subject to fair use policy).
Fair use policy: el refund de 30 días aplica para clientes evaluando el Servicio de buena fe. Uso excesivo durante el período de refund (definido como exceder 2× el scan limit mensual de tu tier, o escanear más de 50 repositorios en 30 días) anula la elegibilidad para refund.Fair use policy: the 30-day refund applies to customers evaluating the Service in good faith. Excessive use during the refund period (defined as exceeding 2× your tier's monthly scan limit, or scanning more than 50 repositories in 30 days) voids refund eligibility.
06 Comportamiento al Exceder LímitesBehavior on Exceeding Limits
Si el Cliente excede el límite de scans/mes de su tier:If Customer exceeds the monthly scan limit of their tier:
- 80% del límite: banner amarillo + email informativo80% of limit: yellow banner + informational email
- 100% del límite: banner rojo, los scans continúan durante un grace period de 7 días100% of limit: red banner, scans continue during 7-day grace period
- Día 8 desde el 100%: hard block — nuevos scans bloqueados hasta upgrade o inicio del siguiente cicloDay 8 after 100%: hard block — new scans blocked until upgrade or next cycle start
Musha nunca cobra overage automáticamente. El upgrade es voluntario.Musha never charges overage automatically. Upgrade is voluntary.
07 Uso AceptableAcceptable Use
El Cliente acepta usar el Servicio únicamente para escanear código fuente propio o que tenga autorización legal para escanear. Está prohibido:Customer agrees to use the Service only to scan source code that they own or have legal authorization to scan. The following is prohibited:
- Reverse engineering, descompilación o intento de extracción del código fuente de MushaReverse engineering, decompilation, or attempting to extract Musha's source code
- Uso del Servicio para denegación de servicio, scraping abusivo o creación de cargas anómalasUsing the Service for denial-of-service, abusive scraping, or creating anomalous loads
- Evasión de límites técnicos del tier (ej. múltiples cuentas para un mismo proyecto)Circumventing technical tier limits (e.g., multiple accounts for the same project)
- Uso del Servicio para actividades ilegales o violación de derechos de tercerosUsing the Service for illegal activities or violating third-party rights
- Compartir credenciales de cuenta entre múltiples personas no autorizadas por el ClienteSharing account credentials among multiple people not authorized by Customer
08 Propiedad IntelectualIntellectual Property
Musha: retiene todos los derechos de propiedad intelectual sobre la plataforma, el código del Servicio, los algoritmos de scanning, las reglas IaC y los patrones de Secrets detection. Estos no se transfieren al Cliente bajo ningún concepto.Musha: retains all intellectual property rights over the platform, Service code, scanning algorithms, IaC rules, and Secrets detection patterns. These are not transferred to Customer under any circumstance.
Cliente: retiene todos los derechos sobre su código fuente, sus datos, y los findings generados sobre su código. Musha procesa estos datos únicamente para entregar el Servicio.Customer: retains all rights over its source code, its data, and findings generated about its code. Musha processes this data solely to deliver the Service.
Musha no comparte ni transfiere el código fuente del Cliente a terceros bajo ningún concepto. El código se procesa de forma temporal durante cada scan y se elimina automáticamente al terminar.Musha does not share or transfer Customer source code to third parties under any circumstance. Code is processed temporarily during each scan and is automatically removed when the scan ends.
09 SLA y Service CreditsSLA and Service Credits
Los compromisos de SLA por tier se documentan en /pricing.html. Resumen:SLA commitments per tier are documented at /pricing.html. Summary:

10 Limitación de ResponsabilidadLimitation of Liability
En la máxima medida permitida por la ley:To the maximum extent permitted by law:
- La responsabilidad total de Musha frente al Cliente por cualquier reclamación se limita al monto pagado por el Cliente en los últimos 12 meses previos al evento que origina la reclamaciónMusha's total liability to Customer for any claim is limited to the amount paid by Customer in the 12 months prior to the event giving rise to the claim
- Musha no es responsable de daños indirectos, lucro cesante, pérdida de datos, daño reputacional o daños consecuencialesMusha is not liable for indirect damages, lost profits, data loss, reputational damage, or consequential damages
- El Servicio se proporciona "AS IS" sin garantías expresas ni implícitas de comerciabilidad, idoneidad para un propósito particular, o no infracciónThe Service is provided "AS IS" without express or implied warranties of merchantability, fitness for a particular purpose, or non-infringement
- Musha no garantiza que el Servicio detectará todas las vulnerabilidades. Una vulnerabilidad no detectada por Musha no constituye incumplimiento de estos TérminosMusha does not guarantee that the Service will detect all vulnerabilities. A vulnerability not detected by Musha does not constitute a breach of these Terms
Responsabilidad por incidentes de seguridad del Cliente: si el Cliente sufre un incidente de seguridad, brecha de datos, ransomware, compromiso de credenciales o cualquier evento adverso derivado de una vulnerabilidad en su código fuente, dependencias, infraestructura, configuración o prácticas operativas — y dicha vulnerabilidad no fue detectada, reportada tardíamente, clasificada erróneamente o ignorada por el Servicio — ello no constituye incumplimiento de Musha ni genera responsabilidad alguna a su cargo. El Servicio es una herramienta automatizada de ayuda complementaria; la responsabilidad por la seguridad del software, sistemas e infraestructura del Cliente recae exclusivamente en el Cliente, quien debe mantener prácticas adicionales de seguridad (pentest manual, revisiones de código, monitoreo, defensa en profundidad).Liability for Customer security incidents: if Customer suffers a security incident, data breach, ransomware, credential compromise, or any adverse event arising from a vulnerability in its source code, dependencies, infrastructure, configuration, or operational practices — and such vulnerability was not detected, reported late, misclassified, or ignored by the Service — this does not constitute a breach by Musha nor give rise to any liability. The Service is an automated complementary helper tool; responsibility for the security of Customer's software, systems, and infrastructure lies solely with the Customer, who must maintain additional security practices (manual pentesting, code review, monitoring, defense in depth).
11 Indemnización del ClienteCustomer Indemnification
El Cliente acepta indemnizar, defender y mantener indemne a Musha y a su titular de y frente a toda reclamación, demanda, responsabilidad, daño, costo, gasto u honorario legal (incluyendo honorarios razonables de abogado) que se derive de o esté relacionado con:Customer agrees to indemnify, defend, and hold harmless Musha and its holder from and against any claim, demand, liability, damage, cost, expense, or legal fee (including reasonable attorney's fees) arising from or related to:
- Uso del Servicio para escanear código fuente o infraestructura sobre los cuales el Cliente no tenga la autorización legal correspondiente del titular de los derechosUse of the Service to scan source code or infrastructure for which Customer does not hold the corresponding legal authorization from the rights holder
- Violación de derechos de propiedad intelectual, secretos comerciales, o derechos de privacidad de terceros mediante el ServicioViolation of intellectual property rights, trade secrets, or privacy rights of third parties through the Service
- Uso del Servicio en violación de estos Términos, de la Política de Privacidad, o de cualquier ley aplicableUse of the Service in violation of these Terms, the Privacy Policy, or any applicable law
- Conducta dolosa o gravemente culposa del Cliente, sus empleados, contratistas o agentesWillful misconduct or gross negligence of Customer, its employees, contractors, or agents
Esta obligación de indemnización sobrevive a la terminación de la relación contractual.This indemnification obligation survives termination of the contractual relationship.
12 Confidencialidad y DatosConfidentiality and Data
El tratamiento de datos personales se rige por nuestra Política de Privacidad. Para clientes Business+ ofrecemos un Data Processing Agreement (DPA) firmado bajo solicitud.Processing of personal data is governed by our Privacy Policy. For Business+ customers we offer a signed Data Processing Agreement (DPA) upon request.
Musha mantiene confidencial toda la información del Cliente accedida durante la prestación del Servicio. Empleados y proveedores están sujetos a obligaciones de confidencialidad equivalentes.Musha keeps all Customer information accessed during Service delivery confidential. Employees and providers are subject to equivalent confidentiality obligations.
13 Modificación de los TérminosModification of Terms
Musha puede modificar estos Términos. Cambios materiales se notifican al email registrado del Cliente con al menos 60 días de anticipación. Si no aceptas los cambios, puedes cancelar tu suscripción sin penalización antes de la fecha efectiva. El uso continuado después de la fecha efectiva implica aceptación.Musha may modify these Terms. Material changes are notified to Customer's registered email with at least 60 days notice. If you do not accept the changes, you may cancel your subscription without penalty before the effective date. Continued use after the effective date implies acceptance.
Precios: Musha puede ajustar precios. Cambios de precio nunca aplican a clientes existentes sin aviso de 60 días. Clientes legacy mantienen su precio (grandfather pricing) salvo renovación con tier distinto.Pricing: Musha may adjust prices. Price changes never apply to existing customers without 60 days notice. Legacy customers retain their price (grandfather pricing) unless renewing with a different tier.
14 TerminaciónTermination
El Cliente puede terminar la relación en cualquier momento cancelando su suscripción.Customer may terminate the relationship anytime by cancelling their subscription.
Musha puede suspender o terminar el Servicio con causa justa, incluyendo (sin limitarse a): violación de estos Términos, uso prohibido del Servicio, falta de pago por más de 17 días, actividad fraudulenta, o requerimiento legal. Notificaremos al Cliente con la mayor anticipación razonable.Musha may suspend or terminate the Service for cause, including (without limitation): breach of these Terms, prohibited use of the Service, non-payment for more than 17 days, fraudulent activity, or legal requirement. We will notify Customer with maximum reasonable notice.
Tras cancelación o terminación, los datos del Cliente se manejan según la Política de Privacidad: acceso suspendido inmediatamente, datos retenidos en estado pasivo 30 días para reactivación o exportación bajo solicitud, eliminación definitiva al día 31.After cancellation or termination, Customer data is handled per the Privacy Policy: access suspended immediately, data retained in passive state for 30 days for reactivation or export upon request, permanent deletion on day 31.
15 Ley Aplicable y JurisdicciónGoverning Law and Jurisdiction
Estos Términos se rigen por las leyes de la República de Colombia. Cualquier disputa derivada de o relacionada con estos Términos se someterá a la jurisdicción exclusiva de los tribunales de Bogotá D.C., Colombia, salvo que la ley imperativa del domicilio del consumidor disponga lo contrario.These Terms are governed by the laws of the Republic of Colombia. Any dispute arising from or related to these Terms shall be submitted to the exclusive jurisdiction of the courts of Bogotá D.C., Colombia, unless the consumer's home jurisdiction's mandatory law provides otherwise.
Idioma controlante: en caso de discrepancia entre las versiones en español e inglés de estos Términos, prevalece la versión en español.Controlling language: in case of discrepancy between the Spanish and English versions of these Terms, the Spanish version prevails.
16 Disposiciones GeneralesGeneral Provisions
- Acuerdo completo: estos Términos, junto con la Política de Privacidad y el DPA (si aplica), constituyen el acuerdo completo entre las partesEntire agreement: these Terms, together with the Privacy Policy and DPA (if applicable), constitute the entire agreement between the parties
- Separabilidad: si una cláusula se declara inválida, las demás permanecen en pleno vigorSeverability: if a clause is declared invalid, the rest remain in full force
- Cesión: el Cliente no puede ceder estos Términos sin consentimiento escrito de Musha. Musha puede cederlos en caso de M&A o reestructuración corporativaAssignment: Customer may not assign these Terms without Musha's written consent. Musha may assign in case of M&A or corporate restructuring
- No-waiver: el no ejercicio de un derecho por una parte no constituye renuncia al mismoNo-waiver: a party's non-exercise of a right does not constitute waiver of that right
- Fuerza mayor: ninguna parte es responsable por incumplimientos derivados de eventos fuera de su control razonableForce majeure: neither party is liable for breaches due to events beyond reasonable control
